Our
firm gets involved in

probate arena. These include
drafting Wills, Estate
Plans, Living Wills,
Conservator Appointments,
Power’s of Attorney,
Probating Estates, Sale of
Estate owned assets,
Conservatorships, both
voluntary and involuntary,
advice for incapable persons
or their caregivers, name
changes and much more. The
firm frequently accepts work
as court appointed attorney
for the Probate Court
system. This is one way we
are able to give back to our
community in a positive way.
In the Wills and Estate
Planning arena, the client’s
needs are address from a
personal, ideological and
practical perspective. The
client’s wishes, whatever
they are, can be adapted to
allow for an estate plan
that will meet their needs.
An Attorney will discuss
with the client the various
issues that arise when
drafting a will, such as who
is the best person to be my
executor, what is the
Uniform Transfers to Minors
Act and why does it apply to
me, what is really going to
transfer through my will,
and what will happen to my
children. The Estate Plan
the firm prepares for all
clients includes not only a
will, but also a living will
with healthcare intentions
and an appointment of a
financial decision maker in
the event of incapacity. The
client does not have to
create a plan that includes
all documents, however they
are a part of what is
offered as a whole. Such
issues as possession of the
body and cremation, life
support and extraordinary
means are important issues
in today’s social climate.
After a meeting with the
Attorney, you will be given
your estate plan in draft to
review. All questions and
requested changes will be
made before a final estate
plan is executed (signed).
While we are not tax
professionals, we will
discuss general estate tax
guidelines as well as review
your asset scheme, to
determine if trust work will
assist you. We encourage
clients to discuss their tax
issues with their
accountant. The firm will
identify when trust work is
a viable option for the
client and assist the client
in obtaining the best advise
available on how to proceed
in the trust arena.
The firm does get
involved with assisting
executors with maneuvering
through the probate of an
estate. This can be a
confusing process at a very
painful time of life we will
give you step by step
instructions on what to do
next and help you to meet
court deadlines while
avoiding delay. We can help
you account for and dispose
of assets. We can assist you
in your decision making
throughout the probate
process.
Regarding incapable
persons, the firm will
advise clients as to their
rights and obligations
within a Conservatorship or
Guardianship. We will walk
you through the process
required by law and help you
chose the best options,
while making informed
decisions for your loved
ones.
